Terms of Service

These Terms of Service (“Terms”) govern your access to and use of StorySmith, operated by Adam Caza, operating as MYMGG (“we,” “us,” or “our”). By using the service or purchasing a book, you agree to these Terms. If you do not agree, do not use the service.

1. The service

StorySmith is a guided tool that helps you create a personalized, illustrated storybook. You provide inputs, such as a recipient’s name, story choices, and optionally a photo, and the service uses automated and AI-assisted generation to produce a custom story and illustrations, which you can purchase as a finished digital book.

2. Eligibility and accounts

You must be at least 18 years old (or the age of majority where you live) to purchase a book. You are responsible for the accuracy of the information you provide and for activity that occurs under your account. Keep your login credentials secure.

3. Acceptable use

You agree that you will not:

• Upload a photo of a person without the right to do so, or upload a photo of a child unless you are that child’s parent or legal guardian or have their permission (see our Privacy Policy).
• Submit content that is unlawful, infringing, hateful, sexual, harassing, or that depicts or sexualizes minors in any way.
• Attempt to generate content that violates a third party’s rights.
• Misuse, disrupt, reverse-engineer, scrape, or attempt to gain unauthorized access to the service.
• Resell or commercially redistribute the service itself without our written permission.

We may refuse, remove, or refund content or orders that violate these Terms, and may suspend accounts that misuse the service.

4. Your content and the books you create

Your inputs. You retain ownership of the photos and text you provide. You grant us a limited license to use those inputs solely to operate the service and create your book. As described in our Privacy Policy, your original uploaded photo is deleted once you approve the generated hero likeness.

Your finished book. When your purchase is complete, you receive a personal license to use, download, print, and share the finished book you created for personal, non-commercial purposes.

Our materials. The StorySmith application, templates, character personas, underlying software, and branding remain our property and are protected by intellectual-property laws. Nothing in these Terms transfers ownership of those materials to you.

AI-generated content. Stories and illustrations are produced with the help of automated systems. Such output may not be unique and ownership of AI-generated material can be legally uncertain in some jurisdictions. We make no guarantee that generated content is eligible for copyright protection.

5. Payment terms

Books are sold on a one-time, per-story basis. There is no subscription. Prices are shown before purchase and are processed through Stripe. By completing checkout, you authorize us (via Stripe) to charge your chosen payment method for the amount displayed, plus any applicable taxes. Refunds are governed by our Refund Policy.

6. Fulfillment

After payment, we generate and deliver your finished digital book (including a downloadable file and a shareable link). If a technical problem prevents us from delivering a working book, we will work with you to fix it or provide a refund as described in the Refund Policy.

7. Disclaimers

The service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that generated content will meet your expectations. Generated likenesses are stylized illustrations and may not exactly resemble the subject.

8. Limitation of liability

To the maximum extent permitted by law, Adam Caza, operating as MYMGG will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the service. Our total liability for any claim relating to the service or a book will not exceed the amount you paid for the book giving rise to the claim.

9. Indemnification

You agree to indemnify and hold harmless Adam Caza, operating as MYMGG from any claims arising out of content you submit, your violation of these Terms, or your violation of any law or third-party right, including any claim related to a photo or likeness you uploaded without the necessary rights or consent.

10. Governing law

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to its conflict-of-laws rules. Any dispute will be subject to the courts located there, unless applicable consumer-protection law provides otherwise.

11. Changes to these Terms

We may update these Terms from time to time. Material changes take effect when we post the updated Terms and update the “Last updated” date above. Your continued use of the service after changes take effect constitutes acceptance.
